2014-15: Evidentiary Hearings
Hearings were scheduled in Suffolk Superior Court, Boston, between June 2014 and April 2015 to consider Sean Ellis’s 2013 retrial motion.
Judge Carol S. Ball presided.
Arguing for the defense: Attorney Rosemary C. Scapicchio.
Arguing for the Commonwealth of Massachusetts: Assistant District Attorneys Paul B. Linn and Edmond J. Zabin.
After a preliminary hearing in June 2014, seven sessions ensued in which witnesses were called to testify.
The defense zeroed in on:
inadequacies in the 1993 Mulligan homicide investigation - that police failed to follow up leads of named, third-party culprits,
likely corruption in the homicide investigation – carried out by three corrupt investigators with whom the victim was committing crimes, and
discovery materials never before presented to the defense.
Final arguments were presented by the defense and the Commonwealth in April, 2015.
